The agreement, written like a human would write it.

What you can expect from us, what we expect from you, and what happens if things go sideways. We've kept legalese to the minimum the lawyers will tolerate.

01Who you're agreeing with

These Terms govern your use of the websites operated by KD Health Management LLC (DBA The Insurance Insider) — including smartinsurancehelpers.com, smarthealthcoverage.org, and any related properties — and your engagement of our brokerage services.

By visiting the site, contacting us, or becoming a client, you accept these Terms.

02What we do

We're a licensed independent insurance brokerage. We help you compare, select, enroll in, and service health and ancillary insurance plans from third-party carriers. We are not an insurance company. We do not underwrite policies. We do not pay claims — the carrier you enroll with does.

03What this site is (and isn't)

This site is general information. It is not:

Any savings figures, rate ranges, or examples shown are illustrative. Your actual cost depends on underwriting, geography, group composition, and current carrier offerings.

04The broker–client relationship

Visiting this site does not create a broker–client relationship. That relationship begins when you sign a broker-of-record letter or otherwise formally engage us. Until then, we have no fiduciary duty and no recordkeeping obligation specific to you.

06Limitation of liability

To the maximum extent permitted by law, KD Health Management LLC and its agents are not liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of this site or our services. Our total liability for any claim is limited to the commissions we received in the 12 months preceding the claim from the relevant carrier on your account.

This limitation does not apply to fraud, willful misconduct, or any liability that cannot be limited under applicable law (which includes most consumer-protection statutes).

07Carrier disputes & claims

We're not party to your policy. If a carrier denies a claim, you have direct rights against the carrier under your policy and state law. We can help you navigate it — but the legal relationship is between you and the carrier, not us.

08Intellectual property

The content of this site — text, design, logos, "The Insurance Insider" name — is owned by KD Health Management LLC. You may quote and link freely for non-commercial purposes. Don't republish entire pages or scrape the site for AI training without written permission.

09External links

We link to state DOI lookups, carriers, government resources, and occasionally third-party tools. We don't control those destinations and we're not responsible for what they do once you click off our site.

10Communications & consent

When you give us your phone or email, you consent to us using them for service-related communications (quote follow-ups, appointment reminders, renewal notices). You can opt out of marketing emails at any time (every email has an unsubscribe link).

11Termination

You can stop being a client anytime. If you've enrolled in coverage, separating from us as broker requires signing a new broker-of-record (BOR) letter with whoever is replacing us — that's a carrier requirement, not ours. We don't hold your business hostage.

12Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Insurance regulation is fundamentally state-by-state, so the state in which you reside also has consumer-protection authority over how we serve you.

13Disputes

Try to work it out with us first — call us. If we can't resolve it informally, you can:

We don't impose forced arbitration. We don't waive your jury trial rights. We don't include class-action waivers.

14Changes to these Terms

We may update these Terms. Material changes will be flagged with a new effective date at the top of the page. Continued use of the site after changes means you accept the updated Terms.
